Terms of Service

These terms apply to your use of the websites, software, apps and text messages provided by Agrinnovations Inc. ("we", "us"), including Farm Data Solutions and FieldView (together, the "Services"). By using the Services you agree to these terms. If you use the Services for a business, you agree on that business's behalf. A signed service agreement between your business and us takes priority over these terms where they differ.

Accounts

We set up accounts for our customers and the people they authorize. Keep your password and PIN private and tell us right away if you think someone else has used your account. You're responsible for activity under your account.

Your data

Your business's data belongs to your business. You give us permission to store and use it only to provide the Services to you, as described in our Privacy Policy. You can ask for an export of your data at any time.

Acceptable use

Don't misuse the Services. That includes trying to reach data that isn't yours, interfering with the Services, reverse engineering them, or using them to break the law.

Fees

Fees for the Services are set out in your quote or service agreement. We don't sell anything inside our apps.

Text Messaging Terms

These terms cover the FieldView text alerts program run by Agrinnovations Inc..

• What it is: account and work notifications for the growers, farm labor contractors and crew leaders who use our Services, such as sign-in and verification codes, timesheets and injury reports ready to review or sign, crew and schedule updates, and replies to questions you send us. We don't send marketing or promotional messages.
• Signing up: you sign up by ticking the consent box on our sign-up form, or by giving your consent to your employer or to us when your account is set up. Consent is never a condition of any purchase.
• Message frequency varies with your account activity.
• Message and data rates may apply. Check your mobile plan for details.
• Opting out: reply STOP to any message to stop receiving texts. We'll send one message confirming you've been unsubscribed, and no more after that. To start again, reply START or sign up again.
• Help: reply HELP to any message, call (559) 493-8981 or email tyler@farmdatasolutions.co.
• Carriers are not liable for delayed or undelivered messages.
• Your number: only sign up with a mobile number you own or are allowed to use, and tell us if you change or give up that number.
• Privacy: we never sell or share your mobile number or text-messaging consent with third parties or affiliates for marketing. See the Text messages section of our Privacy Policy.

Availability and changes

We work to keep the Services available and accurate, but they may sometimes be unavailable, and we may change or improve them over time.

Disclaimers

The Services and the reports they produce are tools to help you run your operation. They're provided "as is", to the extent the law allows. Business, farming, payroll and legal decisions remain yours.

Limitation of liability

To the extent the law allows, Agrinnovations Inc. is not liable for indirect, incidental or consequential damages, and our total liability for any claim is limited to the fees you paid us for the Services in the 12 months before the claim.

Ending your use

You can stop using the Services at any time. We may suspend accounts that break these terms. If your account closes, we will export your data on request, as described in our Privacy Policy.

Governing law

These terms are governed by the laws of the State of California.

Changes to these terms

We may update these terms. We'll post the new version on this page with a new effective date, and tell customers about material changes.
